Gov. Jerry Brown on Friday signed legislation that expands the legal definition of rape and imposes new mandatory minimum sentences on some sexual assault offenders -- measures inspired amid national outcry over the sexual assault case of former Stanford swimmer Brock Turner.
The decision comes as heated debate has raged this year over the mishandling of sexual assault investigations on U.S. college campuses by police agencies and courts. But increasing punishment for sex offenders posed a challenge for Brown, as the state has been undertaking a broader effort to move away from a focus on prison sentences.
In a message released with his signature, Brown said he was generally opposed to adding more mandatory minimum sentences.
"Nevertheless, I am signing AB 2888, because I believe it brings a measure of parity to sentencing for criminal acts that are substantially similar," he said.
Assembly Bill 2888, authored by Assemblyman Evan Low (D-Campbell) and Assemblyman Bill Dodd (D-Napa), will prohibit judges from giving convicted offenders probation when they sexually assault someone who is unconscious or intoxicated.
Assembly Bill 701 by Assemblywomen Cristina Garcia (D-Bell Gardens) and Susan Talamantes Eggman (D-Stockton), will expand the legal definition of rape so it includes all forms of nonconsensual sexual assault.
Currently under the law, those convicted of rape using additional physical force must serve prison time. But offenders, like Turner, convicted of sexually assaulting someone who is unconscious or incapable of giving consent because of intoxication, can receive a lesser sentence based on a judge’s discretion.
Rape has previously been defined as “an act of sexual intercourse" under certain conditions of force, duress or lack of consent. Other types of sexual assault, like penetration by a foreign object, were categorized as separate offenses.
Only three out of every 100 rapists will ever spend even a single day in prison, according to a new analysis by RAINN of Justice Department data. The other 97 will walk free, facing no consequences for the violent felony they have committed. Because rapists tend to be serial criminals, this leaves communities across the nation at risk of predators.
While the percentage of rapes reported to police has risen in recent years, a majority — 54% — still are not reported, according to the Justice Department. But increasing reporting alone won't solve the problem: only about one out of four reported rapes leads to an arrest, and only about one out of four arrests leads to a felony conviction and incarceration.
RAINN's new analysis is based on the most recent available Justice Department data, using an average of the five most recent years when available. Based on older data, RAINN had previously estimated that about 6% of rapists ultimately go to prison for their crime.
"This staggering statistic sends a clear message to offenders that they can commit this horrible crime and get away with it. The single most important thing we can do to prevent rape is to put more rapists in prison," notes Scott Berkowitz, RAINN's president and founder. "That's why we have made it a priority to pass the SAFER Act and eliminate the backlog of untested DNA evidence from open rape cases."

But now, almost $80 million is being earmarked to help clear the massive backlog and hopefully get justice for sexual assault survivors.
Manhattan District Attorney Cy Vance is putting $38 million in forfeiture funds toward the cause.
"We have finally come together to solve one of our law enforcement community's biggest embarrassments which is having treated sexual victims, particularly women, not as seriously as we have treated other kinds of crimes and victims," Vance told NBC News.
Vice President Joe Biden and Attorney General Loretta Lynch are set to announce that the Department of Justice is setting aside $41 million for the effort.
"The bottom line is simple—if we're able to test these kits, more crimes could be solved and more women can live with the comfort of knowing her rapist will not return," Biden said in a statement.
The grants will be announced Thursday afternoon at a press conference in Manhattan, where the officials will be joined by "Law and Order" actress Mariska Hargitay, whose Joyful Heart Foundation has championed the cause for years.
The problem came to public attention five years ago when a Detroit prosecutor, Kym Worthy, discovered 10,000 kits were sitting neglected in a dingy warehouse. The city just finished testing those kits and found 487 suspected serial rapists and links to cases in 39 states.

A rape victim named Johnnie, whose attacker went free for 13 years until her kit was tested by Detroit, said the huge numbers of untested kits around the country are "disturbing."
"It's survivors out there that need closure," she said.
"WE HAVE FINALLY COME TOGETHER TO SOLVE ONE OF OUR LAW ENFORCEMENT COMMUNITY'S BIGGEST EMBARRASSMENTS."
Vance's office is giving grants, ranging from $97,000 to $2 million, to 32 other agencies to test more than 56,000 of the so-called "rape kits," which include DNA samples taken from victims' bodies after attacks.
The cash is coming from settlements that the DA's office struck with international banks that violated U.S. sanctions.
The Justice Department grants, approved by Congress last fall, will be used to test 13,500 kits in 20 jurisdictions.
"For anyone who has felt isolated and afraid, left out and left behind as a result of a sexual crime, our message is clear: we will not forget you. We will not abandon you. You are not alone," Lynch said.
The money will mean all the difference in Las Vegas, where the city has been struggling to get rid of a backlog of 6,300 cases at a rate of 100 a year. With a grant from Vance's office, it expects to have tested them all within three years, using an outside lab.
"I think there is value in every kit," said Kimberly Murga, lab director for the Las Vegas Metropolitan Police Department. "We would like to end the backlog. We just need the resources."
The new funds will make a big dent but won't completely solve the problem.
Documents obtained by USA TODAY Media Network, an NBC News partner, uncovered more than 70,000 neglected forensic evidence kits amassed by more than 1,000 police agencies. That's just a fraction of the nation's 18,000 police departments, so the total number of untested kits is likely far higher, in the hundreds of thousands.
"To have those kits untested, in some case for decades, is wrong," Vance said.
"We had 17,000 untested kits in New York. And when those kits were ultimately identified and tested, we had 49 indictments out of New York City, in Manhattan alone."
Vance said that going forward, law enforcement needs to ensure there are no new backlogs.
"We have to completely reverse the approach that led us to have unsolved rape kits in storage units all around the country," he said. "It's a disgrace. How it got to that point, I can't answer. But I do know that we can solve it."

Police say a man in India took the law into his own hands when he used a fake dinner invitation to lure his daughter's alleged rapist over for a night of torture and, ultimately, murder.
The father allegedly discovered his daughter had been raped by a 45-year-old married medical supplier while he was away on a business trip. According to the Indian Express, the girl told her father what happened despite threats of violence.
Fearing "a bad name for his daughter," the man bypassed police and dealt out his own deadly justice.
Reports the Express:
"The father called the medicine supplier over to his house saying he wanted to discuss some issue. He served him dinner. After the meal, the father overpowered the man and tied him to a chair. He got heated tongs and burned the supplier's genitals before strangling him to death. He came to the police station and surrendered himself," an officer said.
The father reportedly told police he had planned his revenge from the moment he found out about the rape but never intended to kill the man.

The U.S. Department of Justice Office on Violence Against Women unveiled a new website Wednesday aiming to help guide colleges on how to address sexual violence on campus.
The website, changingourcampus.org, is billed as a one-stop-shop for administrators, faculty and staff at colleges and universities. It includes round ups of research and resources specific to dating and domestic violence and stalking, both issues that colleges are obligated to address in addition to sexual assault due to the gender equity law Title IX.
Schools can also engage in a compliance check with the campus safety law the Clery Act, and watch webinars and listen to podcasts about how to respond to reports of sexual assault from students. The website includes information on groups students can go to, like End Rape On Campus, if they are interested in filing a complaint against their school. There are plans to add resources specific to historically black universities, faith-based schools and tribal colleges.
The DOJ pledged in a news release to "seek guidance and input from campus-based experts, campus communities, and grassroots groups" committed to ending sexual and intimate-partner violence.

New bill requires, female students to first verbally agree to having sex. Only when a woman has "an affirmative, conscious and voluntary agreement to engage in sexual activity", should a male student proceed.

If a female student doesn't say yes or doesn't say anything at all, it means she does not want sexual contact. This is what this new bill in California states, by Governor Jerry Brown. Basically if the female student is silent, lacks resistance, asleep, is drunk or unconscious… if she doesn't say "YES", she should not be sexually touched or manipulated!
You would think that a law like this is not necessary for college students, but sometimes placing rules, might bring up a red flag and help prevent sexual assaults by male students. We praise Governor Jerry Brown for signing this bill and hope that other colleges or universities follow suit.
President Obama is trying to involve college campuses into combating the predominant issue of rapes or sexual assaults against women on college campuses. An agenda he backed since the beginning of his administration.

Although Obama's effort is a welcomed one by us ladies and decent men, in our view, it's not the total solution for this abusive stance our country and other nations have. You see, sexual assault is not a law issue, it's a society issue. No law by Obama will fly, unless society breaks the habit of how men perceive women in general, throughout their lives.
Women will be treated with decency and not raped, when children see their father respect and love their mother. When they see that, unlike some football players shown on TV lately, they love and help their wife throughout their marriage. When there is no domestic violence! Children exposed to couples who truly love and respect each other, usually pattern their own relationships to what their parents were like. Hate to say this, but the saying "monkey see, monkey do", comes to mind! Only when a couple of future generations, practice this mutual respect for each other, will our society really change.
So you ladies that aren't married yet, keep in mind that before you accept to marry someone, make sure they love and RESPECT you. Never become a model of domestic violence or rape for your children, whether they are male or female!

Seems like Oklahoma is having issues with their State Troopers! Another officer, Daniel Holtzclaw, previously had raped 8 women while on duty… In Eric Robert's case, there were cameras… But what good will they do, when an officer can turn off their dashboard camera and microphone from their uniform? Sure enough, that's what he did!
This brings us to the question: are cameras for just the police's benefit? Shouldn't these videos be mandatory for all officers and shouldn't they NOT have an OFF SWITCH? Seems to us that a video constantly ON, will track the person's action and or the trooper's behavior. It's ridiculous to try to make out what exactly happens in a crime, when evidence can be tampered with or not shown at all.
Just as civilians are video taped, so should police officers or State Troopers like Eric Roberts and Daniel Holtzclaw. Especially when they rape women! Let's do it right. Presently, police have the upper hand… and sometimes their hands can also commit crimes as well.

Unbelievable! An Attorney named Javier Armengau, 52, tried to persuade a mother who's son was in court, that if she had oral sex with the Judge, she would have a reduced sentence for her son.
The woman refused to do it, so Javier Armengau himself, supposedly raped her in a conference room. According to the mother, he stripped naked and masturbated in front of her for at least 10 separate occasions, as well. Plus, this mother, was not the only one that the attorney approached or raped. 4 Other women have also accused him of similar acts.
All 5 women have brought charges against Javier Armengau. He is being accused of rape, kidnapping, sexual battery, gross sexual imposition and public indecency!
We wonder if the Judge, had any idea of what this attorney was doing in his conference room with these helpless women. If the Judge knew, he too should be charged.
